TERMS OF SERVICES
Gerneral Terms
- Validity of Web Space /Email Space/ Cloud Email / Domain Name Registration or any other service is for 1 year from the date of account creation / date of registration unless otherwise specified.
- The service entitlement / features are not transferable.
- Official communication has to be sent to support@spearheadtech.com for any changes to be made in postal address, e - mail ids or any other service features.
- Payment has to be sent before the Due / Renewal / Expiry Date mentioned in the invoice failing which account will be deactivated. We are not responsible if domain not renewed on time, If domain not renewed we are not responsible if some body take it for there personal use.
- Accounts cannot be used for any of the following purpose : Bulk mail, Spamming or sending UCE ( unsolicited commercial mail ), software piracy, distribution of pornographic material, Publishing of obscene pictures, hacking or attempting to use machine or network resources for unlawful / illegal purposes or any other illegal activity. Any account violating these rules will be terminated without notice if notification comes from concerned department and no refunds will be issued, not withstanding penal provisions under the Indian Cyber laws enacted by the Govt. of India from time to time.
- If Domain / Serrver / Website founds in Malicious activities services will be terminated after Notification
- Spearhead does not and will not help in debugging ASP/PHP/JAVA scripts. If you cannot get your ASP scripts to work properly, consult the Microsoft website or one of the readily available books about ASP/PHP/JAVA. Please Upload content without Virus, FTP Service not supported by any Anti-Virus filtering. Please use complex passwords for Control Panels, Databases, FTP and Mailboxes while creating the service and keep it changing frequently.
- Data transfer charges per month will be applicable for clients who exceeds the bandwidth limit set by the company.
- 30 days advance notice is required for withdrawal of service from clients for the following services VPS, Dedicated server hosting and Co-location hosting.
- Services are provided on 'as is where' basis. Spearhead cannot and will not be held liable for any loss, damages, whether direct, indirect, incidental or consequential that may arise out of use of Spearhead's services.
- Spearhead is not responsible for the sanctity or authenticity of web contents of any website uploaded by their clients.
- Spearhead reserves the right to alter, amend or change these policies at any time. All accounts are required to comply with any changes made to these policies while their account are active. Notification of any major changes to the policies will be emailed to all accounts.
- Renewal account are advised to pay the annual charges before due date of their accounts to avoid deactivation.
- Service specifications and pricing subject to change without notice.
- Spearhead reserves the right to register/renew/transfer domain names of the existing/new customers.

- Technical support is available for standard web sites with standard features but in case the client is going to run web application like CRM/CMS etc with database support then they need to inform our tech and sales department while placing the order /uploading the content as the support for these sites will involve additional charges.
- All Legal matters subject to Mumbai jurisdiction.
- Domain Name Registration/Renewal will be done only for Spearhead clients i.e. those who avail Domain Registration form Spearhead .
- Backup of website content taken once in 7 days and that will be used only for disaster recovery of servers. Clients are expected to have the backup of website content and database regularly. No Back up will be provided on individual website basis.
- Mail Backup will not be provided for mails inside web mail folders. Clients are requested to download the mails regularly through local mail client
- Bulk Mailing - Clients are requested not to send bulk mails in any form (solicited or unsolicited or commercial mails). The service will be deactivated if client is found sending bulk mails without notification. Clients should not send more than 450 mails per hour on regular basis through one domain/Cpanel Account.. For Shared Hosting cutomers can't send more than 100 mails per hour per user and 300 mails per domain may result mail bounce till 1 hour and limit gets reset in next hour.
- Resource Usage - In a Shared Hosting environment we can't allow a single website or databases or Mail services to use any of the system resources more than 10% for a period longer than 60 seconds will be deactivated immediately with out any notifications and your web site will remain stopped until you are able to resolve this issue in a local development environment and ensure this type of usage will not repeat.
- Scheduled Maintenance - To ensure optimal performance and security of the Services, Spearhead will routinely perform maintenance on a regularly scheduled basis within its published maintenance windows. This may require specific Services to be suspended during the maintenance period. Spearhead schedules maintenance windows according to its policies. Service unavailability due to scheduled maintenance will be excluded from “Your” uptime calculations for availability. Spearhead will use commercially reasonable efforts to notify “You” in advance of any scheduled maintenance that may adversely affect “Your” Services.
- Emergency Maintenance - Under certain circumstances Spearhead may need to perform emergency maintenance, such as security patch installation or hardware replacement. Spearhead will not be able to provide “You” with advanced notice in case of emergency maintenance. Service unavailability due to emergency maintenance will be excluded from the uptime calculations.
- Uptime - Spearhead shall provide at least 99.9% Service Availability, measured on a per calendar month basis. For the purpose of the Services, “Service Availability” is defined as the ability caused by issues beyond Spearhead ’s reasonable control, including denial of service or similar attacks, mail bombs, DNS resolution, Domain Name expiration, Internetavailability, SYN attacks, and other events or any other Force Majeure event will be excluded from Service Availability calculations and for the same Spearhead shall not be in any way liable.

Premium AntiSpam Services
- Anti Spam Activation is subject to Mail Filtering on Domain Level only and will be charged on user basis
- Any Mail suspect as Spam as per the definition of SPAM will be Quarantine.
- Spam Definitions gets updated automatically with feedback from Global Servers
- If you received Spam in large numbers then kindly inform us on time./span>
- We refer to the Global Spam List i.e. Real-time Black List which gets updated every few hours
- Our Antivirus scan engine gets updated every few hours.
- You can use white list option if you are too sure that sender is not going to send you spam mail.
- Some mails may bypass our Spam filtering solution so it will not protect you 100% from Spam, but we assure you it will protect you 95%
- Additional Users can be added in slot of 5 Users
SpearMail
- License for SpearMail is valid only for a machine used within 1 Network only and it is not transferable
- Spearhead is not responsible for SpearMail OR Outlook data backup
- One Year free support only for new purchase & is not applies for User or Version Upgradation
- Our trained engineers will attempt to resolve the issue over e-mail/ telephone /Remote Access.
- If any physical visit (in Mumbai Area only) to be made then it will cost Rs.1500/- + Taxes as a visit charge.
- We will charge additional Rs. 750/- per visit, if our engineer determines that problem is caused by Products not sold by spearhead
- Spearhead is not responsible if any change in unauthorized change made in configuration
- No support for SpearMail will be provided if AMC for SpearMail is not sign-up
Bulk Email
- Any illegal use of the Bulk Email service is strictly prohibited. We will not be responsible for content of messages sent and any legal action taken by respective departments.
- Try to keep bounce rate below 5% which should be prevent suspension of account.
- Already un-subscribed mail ids must not be in the list , otherwise account will be suspended.
- No purchased / Rented/ 3rd party lists allowed (no matter how expensive).
- We shall attempt to deliver all emails. We does not take responsibility for the failure of any email delivery or loss of any email, and shall not refund Customer for any undeliverable email.
- Customers are advised to maintain and keep current copies of its mailing lists and all related information.
- We reserve the rights to delete any account 90 days old data
- We shall not be liable for any type of losses
- Account may be suspended on violation of any terms and conditions or on sending Spam
Bulk SMS
- Any illegal use of the SMS service is strictly prohibited. We will not be responsible for content of messages sent and any legal action taken by respective departments.
- Sender id is subject to approval, Sender ID must be 6 character Alphabets in capital (Like- SPEARH). Sender ID is allowed only for Transactional SMS.
- Promotional message can't be sent via Transactional SMS Route. If you send Promotional message via Transactional SMS Route then they will be sent using Code instead of Sender ID
- Promotional messages will not be delivered to DND Numbers and can be sent from 9:00 am to 9:00 pm
- Any special character or any symbols are not acceptable in massage content.
- One SMS credit =160-character message including space.
- We shall have no liability for any interruption or delay irrespective of the cause, we shall not be liable for any type of losses
